How to leave a gift in your Will

Whether you’re passionate about supporting older people to remain independent and enjoy an excellent quality of life, or someone you know living with dementia has been helped by music and social groups, you could make a big difference by including a gift to With Music In Mind in your Will.

If you are writing a new Will, or would like to make a gift in your existing Will, find a solicitor to help you.

A solicitor will be able to advise you on leaving charitable gifts when making a Will. You will also need to think about a few things:

  • Who will be named as your executors; the people who will make sure your wishes are fulfilled
  • Calculate the value of your assets
  • Choose the family and friends you’d like to remember and whether you would like to consider leaving anything to a charitable cause.
  • Decide what gift you would like to leave and ask your solicitor to include it in your Will

A valid Will must be in writing, signed by the testator (who must have capacity), and by two witnesses present at the same time.

There are three main categories of gifts:

A residuary gift refers to any portion of your estate that remains after payment of debts, administration expenses and distribution of any specific gifts.

A pecuniary gift refers to a specific amount of money you desire to donate. Such gifts can be expressed to be ‘index linked’ so the sum gift holds its value in line with inflation.

A specific gift refers to a specific item you wish to leave, e.g. jewellery, artwork or furniture.
