1. The Promoter
    1. The promoter is: With Music In Mind CIC, a community interest company limited by guarantee with company registration number 12057024 and its registered office address at 6 Mill Park, Cowbridge, Vale Of Glamorgan, CF71 7BG.
    2. The Promoter aims to improve the quality of lives of older people through singing and exercise groups and social networking.
  2. The competition
    1. The title of the competition is the 2022 Calendar Competition.
    2. The competition is open to anyone with an interest in the work of the Promoter to submit a photograph based on one or more of the following themes:
      • Our local area
      • Older people
      • Music
      • Health and Wellbeing
      • Happiness
    3. The aim of the competition is to raise funds to support the Promoter’s community work.
  3. How to enter
    1. The competition will run from 9am on 6 July 2021 (the Opening Date) to 12pm on 20 August 2021 (the Closing Date) inclusive.
    2. All competition entries must be received by the Promoter by no later than 12pm on the Closing Date. All competition entries received after the Closing Date are automatically disqualified. Entries may be e-mailed to info@withmusicinmind.co.uk, sent by post to the Promoter’s registered office address or handed to the Promoter at one of its social groups.
    3. To enter the competition you must:
      (a) send your photograph to the Promoter in the manner described above;
      (b) include with the photograph:
      (i) details of what it is of or where it was taken, and which category you feel it fits into and why;
      (ii) one or two sentences about what the Promoter’s work means to you; and
      (iii) your name, address, e-mail (if relevant) and phone number; and

      (c) pay the entry fee of £2.00 either in cash, cheque or bank transfer

    4. If paying the entry fee online you must include your details and reference the competition so that it can be identified.
    5. Only one photograph may be submitted per entry. However, you may submit as many entries as you wish (paying the entry fee each time). Competition entries cannot be returned.
    6. The Promoter will not accept:
      (a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      (b) proof of posting or transmission as proof of receipt of entry to the competition.
    7. By submitting a competition entry, you agree to be bound by these terms and conditions.
    8. The competition entries will be judged by a panel of three directors / employees of the Promoter. The judges will select 12 entries from those submitted to feature in the Promoter’s 2022 calendar. The judges will select entries that they feel best represent and highlight aspects of the work of the Promoter and that, in their view, work together as a cohesive set of 12 entries. The decision of the panel of judges, acting reasonably, will be final.
    9. A list of names of the judges will be published on the Promoter’s website when announcing the winning entries, and will remain on the website for a period of at least 30 days.
  4. Eligibility
    1. The competition is only open to all residents in the UK aged 18 years or over, except:
      (a) employees of the Promoter or its holding or subsidiary companies;
      (b) employees of agents or suppliers of the Promoter, who are professionally connected with the competition or its administration; or
      (c) members of the immediate families or households of (a) and (b) above.
    2. Parents may submit entries on behalf of their children.
    3. In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter reserves the right to require you to provide proof of your eligibility to enter the competition.
    4. The Promoter reserves all rights to disqualify your entry if it is contrary to the spirit or intention of the prize competition.
  5. The prize
    1. The prize is a free copy of the Promoter’s 2022 calendar featuring the winning entries. Each of the 12 winning entrants will receive the prize.
    2. The prize is considered to have limited monetary value and there is no cash alternative for the prize.
  6. Winners
    1. The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.
    2. The judges will make their decision within 14 days of the Closing Date.
    3. The Promoter will contact each winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry.
    4. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the name of each prize winner and their winning entries on its website (https://www.withmusicinmind.co.uk) within 7 days of their decision being made.
    5. If you object to any or all of your name and winning entry being published or made available, please contact the Promoter. In such circumstances, the Promoter is legally required to still provide the information and winning entry to the Advertising Standards Authority on request.
  7. Claiming the prize
    1. The Promoter’s 2022 calendar containing the winning entries will be produced by [1 December 2021]. It will be delivered to the winning entrants by post to their address on or before [14 December 2021]. Alternatively winning entrants may arrange to collect a copy of the calendar from the Promoter.
    2. The Promoter will contact the each winner in advance of sending the calendar in order to confirm their address. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, the Promoter reserves the right to withhold the prize until such time as the Promoter is able to contact the winner.
  8. Limitation of liability
    Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate any entrant or accept any liability for any loss or damage howsoever caused in connection with their participation in the competition. Your statutory rights are not affected.
  9. Ownership of competition entries and intellectual property rights
    1. The Promoter does not claim any rights of ownership in your competition entry. All such rights will remain with you.
    2. However, by submitting your competition entry and any accompanying material, you agree to that the Promoter may, but is not required to, make your entry available on its website https://www.withmusicinmind.co.uk and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
  10. Data protection and publicity
    1. The Promoter will only process your personal information as set out in its privacy policy available available by following the link at the bottom of this page. See also clause 6 of these terms and conditions, with regard to the announcement of winners.
  11. General
    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
